NADA Celebrates Major Legal Win as Court Strikes Down FTC’s CARS Rule

In a major victory for auto dealers, the National Automobile Dealers Association (NADA) is celebrating a decision by the 5th Circuit Court of Appeals to vacate the Federal Trade Commission’s (FTC) controversial Combating Auto Retail Scams (CARS) Rule. This legal win comes after NADA, alongside the Texas Automobile Dealers Association (TADA), challenged the rule, arguing that it would have added unnecessary complexity and costs to the car-buying process.

NADA CEO Mike Stanton hailed the court’s ruling as “a win for the rule of law and a huge victory for consumers,” emphasizing that the decision helps protect the interests of both auto dealers and their customers.

The CARS Rule was designed to improve transparency and safeguard consumers from deceptive practices within the automotive retail sector. However, critics warned that its implementation would have burdened consumers with more paperwork and lengthened the car-buying experience. NADA argued that the rule was too cumbersome and would have ultimately harmed both the retail process and consumers’ experiences.
