Toyota’s truck division, Hino, has agreed to pay $1.6 billion as part of a settlement related to the emissions scandal.

A Toyota subsidiary that manufactures trucks will pay more than $1.6 billion and confess to providing false emissions and fuel consumption data to regulators, in addition to unlawfully smuggling engines into the U.S.

The Justice Department revealed that Hino’s illegal actions allowed the company to improperly gain approvals to import and sell over 110,000 diesel engines in the U.S. between 2010 and 2022. These engines were mostly installed in heavy-duty trucks made and sold by Hino across the nation.

“Hino knew the engine certification requirements for the U.S., but chose to falsify data for years to avoid regulations,” said Todd Kim, Assistant Attorney General for the Justice Department’s Environment and Natural Resources Division. “This led to significant pollution and violated crucial environmental, consumer protection, and import laws.”

Hino Motors Ltd. has agreed to plead guilty to a long-running criminal conspiracy. As part of the deal, which still requires court approval, the company will pay a criminal fine of $521.76 million, serve five years on probation (during which it will be prohibited from importing any diesel engines into the U.S.), and put in place a comprehensive compliance and ethics program.

On top of that, Hino has agreed to a forfeiture judgment of around $1.1 billion. Future payments related to civil settlement obligations, including those tied to a class action lawsuit, will be credited toward the criminal forfeiture amount.

This settlement includes the Justice Department, the Environmental Protection Agency, the FBI, Customs and Border Protection, the Department of Transportation’s Office of Inspector General, the National Highway Traffic Safety Administration, and the State of California. The resolutions are now awaiting approval by the U.S. District Court for the Eastern District of Michigan.
